The petitioner is apprehending his arrest in connection with Kochadhaman P.S.Case No.153 of 2015 registered for offences punishable under Sections 363, 366(A), 372, 120(B)/34 of the Indian Penal Code.
Allegation against the petitioner as per FIR is of kidnapping the daughter of the informant and the informant apprehends that her daughter has been taken to push into the prostitution and the name of one Manowaer Alam and his family members has also transpired in this case.
Submission of the learned counsel for the petitioner is that he is brother of Manowaer Alam and no specific allegation has been attributed against him. It is also submitted that the trial of the other co-accused has been separated. The statement of the girl has
Patna High Court Cr.Misc. No.42374 of 2018 (3) dt.27-07-2018 2/2 also been recorded and the girl has not named the petitioner and his family members .

Having heard both sides and in view of the facts and circumstances, as stated above, I am not inclined to grant anticipatory bail to the petitioner rather let the petitioner surrender before the learned court below within a period of four weeks from the date of receipt of the order and make prayer for regular bail, which will be considered by the learned court below on basis of materials available on the record especially the evidence of the girl in the case for the trial, which is going on, if possible on the same day.
