Petitioner apprehends his arrest in connection with Brahmpur P.S.Case No. 116 of 2017 registered for the offences punishable under Sections 420, 467, 468, 471 and 34 of the Indian Penal Code.

Allegation against the petitioner, who was Panchayat Sewak of the Gram Panchayat, is of embezzlement of Old Age Pension Scheme.

Submission of learned counsel for the petitioner is that he retired from service on 31.1.2015 and the occurrence was dated 17.9.2015 and the period was 2006-07 for the distribution of Old Age Pension, i.e., after his retirement. Furthermore, the main accused has already been granted privilege of anticipatory bail

Patna High Court Cr.Misc. No.44664 of 2018 (2) dt.01-08-2018 2/2 vide order dated 20.3.2018 passed in Cr.Misc.No. 3906 of 2018 by a co-ordinate Bench of this Court.

Having heard both sides and in the facts and circumstances, let the petitioner, named above, in the event of his arrest or surrender, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Buxar, in connection with Brahampur P.S.Case No. 116 of 2017, subject to the conditions as laid down under Section 438(2) Cr.P.C. and further condition is that one of the bailors shall be a local person having sufficient immoveable properties within the jurisdiction of court concerned.
