Petitioners are apprehending their arrest in connection with Complaint Case No.1340Cof 2018 registered for offence punishable under Sections 420, 468, 120B of the Indian Penal Code.

As per Complaint, all accused persons including the petitioners in connivance with employee of the land acquisition office prepared forged and fake document and obtained compensation amount of the land of the complainant. Submission of learned counsel for the petitioners is that petitioners have falsely been implicated in this case. It is stated that as matter of fact, husband of petitioner no.1 had

Patna High Court CR. MISC. No.71060 of 2019(2) dt.07-11-2019 2/2 purchased the land and on that basis petitioner no.1 received compensation amount. It has further been stated that the authority concerned has rightly issued the cheque in the name of this petitioner as the land taken by the Govt. of India is in the name of accused petitioner and she was in possession over the said land.

Heard learned Addl. Public Prosecutor also.

In view of facts and circumstances, as stated above, and considering the order dated 22.10.2019 passed in Cr.Misc.No.66708 of 2019, by which one of the accused persons has been granted anticipatory bail, let both petitioners, named above, in the event of their arrest or surrender before the court below be released on bail on furnishing bail bond of Rs.25,000/-(twenty five thousand) each with two sureties of the like amount each to the satisfaction of learned A.C.J.M.-1, Araria, in connection with Complaint Case No.1340C of 2018, subject to conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
