JUSTICE ASHUTOSH KUMAR ORAL ORDER 04-12-2019 The petitioner seeks bail in connection with Patrakar Nagar P.S. Case No. 604 of 2019 which has been instituted for the offences under Sections 3, 4, 5 of the Immoral Traffic (Prevention) Act, 1956.

It appears that the petitioner was seen along with one Neha Kumari in a compromising position in the house of one Rakesh Kumar. The allegation therefore is that a flesh trade was being carried out from the house of one Rakesh Kumar which had been taken on rent by Vijay Kumar. The petitioner is being prosecuted in this case as one of the customers.

Learned counsel for the petitioner submits that

The lady with whom the petitioner was found to be in an objectionable position is none else but his wife. The petitioner is in custody since 06.08.2019. Considering the nature of accusation and the period of custody of the petitioner, the petitioner, above named, is directed to be released on bail on his furnishing bail bonds of Rs. 10,000/-(Ten Thousands) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Patna in connection with Patrakar Nagar P.S. Case No. 604 of 2019.
