The petitioner is apprehending his arrest in connection with Bhargama P.S.Case No.147 of 2016 registered for offences punishable under Sections 364/34 of the Indian Penal Code. Allegation against the petitioner and the other accused persons is that they have kidnapped the daughter and grand son of the informant and killed them.
Submission of the learned counsel for the petitioner is that this petitioner is 85 % handicap and furthermore the allegation of kidnapping is false and concocted. His grand son has been recovered and he has not named this petitioner and the girl has married with another person and she is residing somewhere else. Heard learned A.P.P. also.
Patna High Court Cr.Misc. No.47154 of 2018 (2) dt.14-08-2018 2/2 Having heard both sides and in view of the fact that earlier the prayer for anticipatory bail of the petitioner had been rejected twice by this Court, in such view of the matter, I am not inclined to grant anticipatory bail to the petitioner, however, the petitioner is directed to surrender before the learned court below within a period of six weeks from the date of order and make prayer for regular bail, which will be considered by the learned court below on the basis of submissions as she is 85 % handicap and considering the same he will pass appropriate order if possible on the same day..
With the aforesaid observation, this application is disposed of.
