2. The petitioner seeks bail, who is in custody since 24.08.2020 in connection with NDPS Case No. 29 of 2020 arising out of Durgawati P.S.Case No.222 of 2020, F.I.R. dated 23.08.2020 registered for the offence punishable under Sections 8/20(b)(ii)(C)/22/27(A) of NDPS Act.
3. Earlier the prayer for bail of the petitioner was twice refused vide orders dated 16.05.2022 and 15.02.2023 passed in Cr. Misc. Nos.22866 of 2021 and 71951 of 2022 respectively.
4. Vide order dated 05.01.2024, a report was called for with regard to the stage of the trial. Report of the learned Trial Court dated 31.01.2024 reveals that out of thirteen chargesheet
Patna High Court CR. MISC. No.83368 of 2023(3) dt.16-02-2024 2/2 witnesses, eleven witnesses have been examined and even the I.O. of the case is examined on 31.01.2024 in part and the case is pending for the examination of the rest of only one prosecution witness.

In view of the report of the learned Trial Court as well as the nature of allegation, I am not inclined to enlarge the petitioner on bail in connection with NDPS Case No. 29 of 2020 arising out of Durgawati P.S.Case No.222 of 2020 pending in the court of learned Addl. District and Sessions Judge-1stcum-Special Judge, Kaimur at Bhabhua.
6. Prayer is refused.
7. However, the learned Trial Court is directed to expedite the trial and conclude the same at the earliest. (Rajesh Kumar Verma, J) Nitesh/- U T
