The petitioner seeks bail in Gwalpara (O.P. Arar) P.S. Case No. 58 of 2015 (corresponding S. T. No. 87/17) instituted for the offences under Sections 323, 341, 342, 354, 307, 504, 506, 34 of the Indian Penal Code in which section 302 IPC was added later on.

The earlier bail application of the petitioner was rejected vide Annexure-1 to the present application taking into account that the fatal injury was caused by the petitioner. A report was called for from the Court below. It has been reported that the only three witnesses are to be examined on behalf of the prosecution and the trial is likely to be

Patna High Court CR. MISC. No.76688 of 2019(3) dt.04-03-2020 2/2 concluded within a period of three months.

Considering the nature of accusation and the stage of the case, I am not inclined to grant bail to the petitioner. The same is rejected. The Trial Court is directed to conclude the trial at the earliest preferably within three months from the date of receipt/production of a copy of this order.
