2. In the present case, the petitioner seeks bail in connection with Katra P.S. Case No. 222 of 2025, dated 01.09.2025, registered for the offences punishable under Sections 126(2), 115(2), 118(1), 109, 352, 351(2), 351(3) & 3(5) of the B.N.S.

3. As per prosecution case, the petitioner assaulted the informant with iron rod causing fracture on his head. The other co-accused persons also assaulted him.

4. Learned counsel appearing on behalf of the petitioner submits that petitioner is innocent and he has falsely been implicated in the present case. The petitioner is cousin of the informant. There is partition dispute between the parties and

Patna High Court CR. MISC. No.75801 of 2025(2) dt.24-11-2025 2/3 for this reason petitioner has falsely been implicated in this case. The injury on the informant is found to be simple. There is inordinate delay of about four days in lodging the F.I.R. and there is no satisfactory explanation for the same. Petitioner has antecedent of four cases and in three cases he is on bail and in one case he has been acquitted. Petitioner is in custody since 02.09.2025 and charge-sheet has been submitted.

5. Learned APP for the State vehemently opposed the prayer for bail of the petitioner.

Having regard to the facts and circumstances and submissions made on behalf of the parties and considering the simple nature of injury of the victim, period of custody of the petitioner and submission of charge-sheet, the petitioner abovenamed, is directed to be released on bail, on furnishing bail bonds of Rs.10,000/- (Rs. Ten Thousand Only) with two sureties of the like amount each to the satisfaction of court of learned Judicial Magistrate, 1st Class, Muzaffarpur (East) /concerned court, in connection with Katra P.S. Case No. 222 of 2025, subject to the condition laid down under Section 480(3) of the B.N.S.. and other following conditions:

(i) One of the bailors will be a close relative of the petitioner.

(iii) In case of non-appearance of the petitioner on single date or in violation of the terms of the bail, the bail bond of the petitioner will be liable to be cancelled by the Court concerned (Arun Kumar Jha, J) Ranjeet/- U T
