JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 04-12-2019 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Sections 413, 414/34 of the Indian Penal Code.

Petitioner and some others were caught and some vehicles were seized. The informant claimed in his written report that petitioner and apprehended accused confessed that they used to sale stolen vehicles.

Submission on behalf of the petitioner is that the seized vehicles were recovered from a Garage and in course of investigation, some witnesses claimed to be owner of the seized vehicle and they admitted that they had sent the vehicles to Garage for repairing work. Moreover, petitioner is a student and

Considering the aforesaid facts and circumstances as well as submissions of the parties and also keeping note of this fact that petitioner is in jail custody since 07.09.2019, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate -Vth Saran at Chapra in connection with Kopa P.S. Case No. 138 of 2019.
