The petitioner seeks regular bail in connection with Teghra P.S. Case No. 128 of 2019 for the offence punishable under Section 394 of the Indian Penal Code.

The allegation is regarding unknown miscreants having intercepted the informant while he was returning from Begusarai to his home at village Dahiya and thereafter had snatched his mobile phone and purse containing various articles. The learned counsel for the petitioner submits that the petitioner has been falsely implicated in the present case and is languishing in custody since 15.07.2019. It is further submitted that the petitioner has been remanded in the present case from one other case i.e. Teghara P.S. Case No. 170 of 2019, after the

Patna High Court CR. MISC. No.72202 of 2019(3) dt.20-01-2020 2/2 accused of the said case had disclosed the name of the petitioner in his confessional statement. It is further submitted that neither any test identification parade has been held so as to connect the petitioner with the alleged crime nor any recovery has been made from the conscious possession petitioner. Having regard to the facts and circumstances of the case, considering the submissions advanced by the learned counsel for the petitioner, coupled with the fact that neither T.I. Parade has been held so as to connect the petitioner with the alleged occurrence nor looted articles have been recovered from the petitioner, I deem it fit and proper to direct for release of the petitioner on regular bail.

Accordingly, the petitioner, above named, is directed to be enlarged on regular bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of learned C.J.M., Begusarai in connection with Teghra P.S. Case No. 128 of 2019.
