2. The present petition has been preferred against: (i) the Order dated 17.9.2019, passed by (Hon'ble Mr. Justice Madhuresh Prasad as his Lordship then was) in C.W.J.C.

No.14393 of 2014 by which the said Hon'ble Bench was pleased to direct the Respondent No. 2 (Director, Fishery, Bihar, Patna), to consider petitioner's claim in the light of relevant part of observation made in

Patna High Court C. REV. No.359 of 2019(3) dt.08-05-2025 2/3 the Order;

The observation in Order are as follows:- Whether charge sheet has been filed in the criminal case or whether here is any impediment on account of pendency of any other Departmental Proceeding or punishment in the Departmental Proceedings is an issue which authorities shall consider. If any junior to the petitioner has been granted promotion and there is no impediment in granting of the same to the petitioner then it should be granted to the petitioner also.

3. A well reasoned order was passed by the writ Court in C.W.J.C. No. 14393 of 2014 (Shashi Bhushan Singh vs. The State of Bihar & Ors.) on 17.09.2019 by allowing the petitioner to represent before the concerned authority who shall be taking the matter to its logical conclusion.

4. The petitioner is agitating for the post of Assistant Engineer. Instead of approaching the concerned respondent, the review petition has been filed.

5. After some argument, learned counsel for the

6. Granting the said liberty, the petition stands disposed of.
