JUSTICE VINOD KUMAR SINHA ORAL ORDER 08-11-2019 Petitioners seek bail in anticipation of their arrest in connection with Sahebpur Kamal P.S. Case No. 148 of 2019, registered for the offences punishable under Sections 304 (B), 201/ 34 of the Indian Penal Code.

As per F.I.R petitioners are Devars in a case under Section 304 (B) IPC.

Submission of the learned counsel for the petitioners is that F.I.R itself shows that demand of motorcycle is against Chanderdeo Yadav, who after death of father of the petitioners is residing with their mother. Further submission is that due to above reasons they are residing separately from her mother and

Having heard both sides, considering the above submission, this application allowed. Let the petitioners, above named, in the event of their arrest or surrender before the Court below within six weeks, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Five Thousand) each with two sureties of the like amount to the satisfaction of learned Chief Judicial Magistrate, Begusarai, in connection with Sahebpur Kamal P.S. Case No.-148 of 2019, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure and further condition is that one of the bailors of the petitioners shall be a local person having sufficient immovable property within the jurisdiction of the Court concerned.
