2. The petitioner is in custody in connection with Pirpainti P.S Case No. 143 of 2025 registered for the offences punishable under Sections 126(2), 115(2), 109, 352, 351(2) and 3(5) of B.N.S.

3. As per prosecution case, petitioner along with coaccused have abused and assaulted the informant and mother of the informant.

4. Learned counsel for the petitioner submits that petitioner has falsely been implicated in this case. It is next submitted that there is general and omnibus allegation has attributed against the petitioner and no specific allegation of

Patna High Court CR. MISC. No.76024 of 2025(3) dt.10-12-2025 2/2 overt act is alleged against the petitioner. It is further submitted that petitioner has got no criminal antecedent as stated in paragraph no. 3 of the bail petition. It is also submitted that petitioner is in judicial custody since 07.08.2025.

5. However, learned APP for the State oppose the prayer for regular bail of the petitioner.

6. On perusal of the FIR and impugned order, it appears that allegation is general and omnibus in nature and there is no specific allegation against the petitioner to assault the informant, although the injuries found on the body of the informant is caused by other accused persons .

7. Considering the aforesaid facts and circumstances of the case and submissions made on behalf of the petitioner, let the above named petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned CJM, Bhagalpur in connection with Pirpainti P.S Case No. 143 of 2025.
