Petitioner seeks bail in a case registered for the offence punishable under section 376 of the Indian Penal Code. Learned counsel appearing for the petitioner submits that petitioner has been falsely implicated in this case. The F.I.R. was lodged after seven months. The statement of the girl was recorded under Section 164 of the Cr.P.C., in which she herself has stated that as the petitioner was not marrying with her, therefore she has lodged the present case against him. Petitioner has no criminal antecedent. Petitioner is in custody since 12.08.2019.

Considering the facts and circumstances of the case

Patna High Court CR. MISC. No.71760 of 2019(2) dt.19-11-2019 2/2 and the submissions advanced on behalf of the parties, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Sub-Divisional Judicial Magistrate, Araria in connection with Araria Mahila P.S. Case No. 61 of 2017.
