JUSTICE VINOD KUMAR SINHA ORAL ORDER 19-11-2019 Petitioner seeks bail in anticipation of his arrest in connection with Desari P.S. Case No. 311 of 2019 registered for the offence punishable under Section 30(a) of Bihar Prohibition and Excise Act.

As per FIR there is recovery of 37 and odd litres of liquor from the house of the petitioner.

Submission of learned counsel for the petitioner is that he has falsely been implicated, having no criminal antecedent and both the father and son have been made accused in this case and father is in custody.

Heard learned APP, who has opposed the prayer for anticipatory bail on the ground that recovery is made from the house of the petitioner.

In view of above facts and circumstances, this

Patna High Court CR. MISC. No.73278 of 2019(2) dt.19-11-2019 2/2 application is disposed of with direction to the petitioner to surrender and pray for regular bail, which shall be considered on the basis of materials available on the record, without being prejudiced by this order and, if possible, to be disposed of on the same day.
