The petitioner is languishing in custody since 22.08.,2019 in a case registered for the offences punishable under Sections 414, 467, 468, 420, 120B of the Indian Penal Code, 1860 and Section 30(a) of Bihar Prohibition and Excise Act, 2016.

It is alleged that 263.90 litres of Indian Made Foreign Liquors were recovered from two vehicles. From Honda Civic car 178.75 litres and from Ford Figo car 85.925 litres of Indian Made Foreign Liquors were recovered.

It is submitted by learned counsel for the petitioner that the car belong to one Guddu Singh and petitioner was

Patna High Court CR. MISC. No.70839 of 2019(2) dt.27-11-2019 2/2 simply passenger in the car. A statement has been made in paragraph 3 of the petition that the petitioner is not having any criminal antecedent. Moreover, investigation has already been concluded.

Learned APP submits that the recovery has also been made from the car in which petitioner was travelling. Considering the fact that the investigation has already been concluded and statement being made in paragraph 3 of the petition that the petitioner is not having any criminal antecedent coupled with the statement made in paragraph 8 of the petition that the car in question is registered in the name of one Guddu Singh, let the above named petitioner be released on bail, on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge, Excise, Patna in connection with Special Case No. 7541 of 2019, arising out of Phulwarisharif P.S. Case No. 803 of 2019.
