JUSTICE ASHUTOSH KUMAR ORAL JUDGMENT Date : 06-02-2020 The petitioners, who are amongst 10% of the senior most professors and are only 15 in number, are aggrieved by the fact that notwithstanding the resolution of the Education Department dated 29.07.2010 entitling them to a grade pay of Rs. 12000/- per month with effect from 01.01.2006, they have not been paid that grade pay. The further grievance of the petitioners is that similarly situated other professors of different streams who are also
Patna High Court CWJC No.23082 of 2019 dt.06-02-2020 2/3 amongst 10% of the senior most professors have been provided the aforesaid grade pay with effect from 01.01.2006 pursuant to an order passed by this Court in C.W.J.C. No. 20715 of 2014 on 08.08.2018.
Learned advocate for the petitioners has drawn the attention of this Court to an office order passed by B.R. Amebedkar Bihar University, Muzaffarpur whereby five of the professors have been allowed payment of the grade pay of Rs. 12000/- per month with effect from 01.01.2006 pursuant to the order of this Court which has been referred to above.
If the cases of the petitioners are similar to the aforesaid five professors, there is no reason why the petitioners also be not treated similarly.
On the petitioners making a suitable representation before the respondent no. 5 (Registrar, B.R. Amebedkar Bihar University, Muzaffarpur) within a period of two weeks, the concerned respondent shall verify the facts, ascertain the entitlement as also the fact that the cases of those five professors are similar to that of the petitioners herein and thereafter shall pass/caused to be passed necessary order in accordance with law. If the claim of the petitioners is found to be tenable, necessary order shall also be passed within a period of six weeks of the receipt of such representation.
