JUSTICE VINOD KUMAR SINHA ORAL ORDER 15-11-2019 This is an application for grant of anticipatory bail in connection with Mahila P. S. Case No. 116 of 2019, disclosing offences under Sections 498A, 323, 504, 506, 341, 34 of IPC and Section 3⁄4 of Dowry Prohibition Act.

As per F.I.R. there is allegation against the petitioner, who happens to be the husband of the informant of demand of Rs.1,50,000/- and for that, assaulting her.

Submission of the learned counsel for the petitioner is that the allegation is false and concocted. He is still ready to keep her with dignity and care and for that, he has filed a petition under Section 9 of the Hindu Marriage Act, being Matrimonial Case No. 140 of 2019 and in spite of notice, the informant has not appeared.

Having heard both sides, considering the above submission, this application is allowed. Let the petitioner, above named, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount to the satisfaction of learned S.D.J.M. Nalanda, Biharsharif, in connection with Mahila P. S. Case No. 116 of 2019, subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure.
