ANJANA MISHRA ORAL ORDER 19-11-2019 Heard learned counsel for the petitioner and learned Additional Public Prosecutor on behalf of the State. The petitioner is in custody since 26.09.2019, in connection with Bisfi (Patauna) P.S. Case No. 289 of 2019, G.R. No. 1826 of 2019 for the offenses under Sections 272, 273, 414 of Indian Penal Code and 30 (a) of the Bihar Prohibition & Excise Act, 2016.

Learned counsel for the petitioner submits that the alleged recovery was not made from the conscious possession of the petitioner but from a bag which was being carried on motorcycle which was allegedly being driven by the petitioner. It is further submitted that the petitioner has got clean antecedent.

Considering the aforementioned facts and

No.71565 of 2019(2) dt.19-11-2019 2/2 circumstances and that the petitioner has no criminal antecedent, let the petitioner, above named, be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional District & Sessions Judge II cum Special Judge, Excise Act, Madhubani, in connection with Bisfi (Patauna) P.S. Case No. 289 of 2019, G.R. No. 1826 of 2019.
