2. The petitioners seek regular bail in connection with Patepur P.S. Case No. 138 of 2025 registered for the offence under Sections 318(4), 303(2), 3(5) of the Bharatiya Nyaya Sanhita, 2023.

3. As per the prosecution case, the petitioners are accused of cheating and stealing the ornaments of the victim. There is recovery of Rs. 1,00,500/- from a hut which the petitioners alleged to have kept for the purpose of marriage of the daughter of petitioner no. 1.

4. Learned counsel for the petitioners submits that

No.78917 of 2025(2) dt.19-11-2025 2/2 the petitioners, without accepting their guilt, are ready to return the alleged amount of Rs. 1,00,500/- to the informant as compensation of her gold ornament and the money which was recovered. The petitioners are in custody since 17.05.2025.

5. Learned A.P.P. for the State has vehemently opposed the prayer for bail.

6. Considering the aforesaid facts and circumstances, this application for regular bail is allowed.

7. Let the petitioners, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Hajipur/concerned Court below in connection with Patepur P.S. Case No. 138 of 2025 subject to condition that:- 7(i). At the time of furnishing bail bonds, the petitioners shall produce a demand draft of Rs. 1,00,500/- in the name of the informant and if the same is produced by the petitioners, the Court below shall hand over the said demand draft to the informant before accepting the bail bonds of the petitioners.
