1. Heard learned counsel for the petitioners and learned A.P.P. for the State.

2. Since both the aforesaid bail applications arise out of the same F.I.R., as such, both are taken up together and are being disposed of by this common order.

3. Petitioners seek regular bail in connection with

Patna High Court CR. MISC. No.82572 of 2024(4) dt.10-02-2025 2/3 Naugachia P.S. Case No. 80 of 2024 dated 09.03.2024 registered under Section 302, 387, 34 of the I.P.C. and Section 27 of the Arms Act.

4. As per the prosecution case, while the informant along with his son was engaged in construction upon his land, three accused persons arrived there on a motorcycle and fired 6-7 bullets upon the informant's son, due to which he sustained fire arm injury and subsequently died.

5. Learned counsel for the petitioners submits that the petitioners are not named in the F.I.R. and they have falsely been implicated in this case on the basis of confessional statement of the co-accused / Ajit Yadav and Rahul Yadav, who are named in the F.I.R. A Co-ordinate Bench of this Court has granted regular bail to the aforesaid accused persons namely, Rahul Yadav in Cr. Misc. No. 79896 of 2024 and Ajit Yadav in Cr. Misc. No. 50298 of 2024 (Annexure-3 Series). The F.I.R. has been lodged after inquest report and post mortem report dated 08.03.2024 inasmuch as after post mortem and inquest report the written report and F.I.R. was lodged on 09.03.2024. The petitioners are in custody since 20.07.2024 & 18.11.2024 respectively. Charge sheet has already been submitted and there is no likelihood that the petitioners will abscond or tamper with

6. Regard being had to the submissions made by the parties, taking into consideration the fact that similarly situated co-accused persons have been granted bail by a Co-ordinate Bench of this Court and charge sheet has been submitted, I am inclined to grant regular bail to the petitioners.

7. Let the petitioners, above named, be released on regular bail on furnishing bail bond of Rs. 10,000 /- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned A.C.J.M. IIIrd, Naugachia & A.C.J.M. 1st Naugachia, District- Bhagalpur respectively in connection with Naugachia P.S. Case No. 80 of 2024 subject to the condition that the petitioners shall remain present on each and every date before the trial court and in case of default on two consecutive dates, their bail bond shall liable to be cancelled.
