The petitioner seeks Anticipatory bail in connection with Aurai P.S. Case No. 17 of 2018 registered under Sections 419, 420, 34 of the Indian Penal Code.

Allegation against the petitioner and other co-accused is of receiving money of old age pension on the basis of wrong age under Indira Gandhi Rastriya Vridha Awastha Pension Scheme.

It has been submitted on behalf of the petitioner that money which has been received by the petitioner has already been deposited in Nazarat, Aurai for which the concerned authority has granted the receipt. It has been further submitted that similarly placed co-accused persons have been granted

Patna High Court Cr.Misc. No.50843 of 2018(2) dt.10-09-2018 2/2 Anticipatory bail by this Hon'ble Court as contained in Annexure- 3 series. Petitioner has no criminal antecedent. Considering the facts and circumstances of the case, prayer of Anticipatory bail is allowed and petitioner named above in the event of arrest or surrender before the court below within four weeks from today, the petitioner is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned Sub-Judge 14th cum A.C.J.M., Muzaffarpur, in connection with Aurai P.S. Case No. 17 of 2018, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
