2. Petitioner apprehends arrest in a case registered for the offences punishable under Sections 191(2), 191(3), 190, 126(2), 115(2), 117(2), 109, 352, 351(2), 324(4) of the Bharatiya Nyaya Sanhita.
3. As per prosecution case, on 12.04.2025 at 7 AM, when informant was sitting in e-rickshaw of Md. Kaif, all the F.I.R. named accused persons, including this petitioner, came there and assaulted him with lathi, danda and damaged the erickshaw. When mother of the informant came to his rescue, she was also assaulted by the accused persons.
4. Learned counsel for the petitioner submits that petitioner is innocent and has committed no offence. Allegation
Patna High Court CR. MISC. No.75658 of 2025(2) dt.05-02-2026 2/2 of assault is general and omnibus and there is no specific allegation of overt act against this petitioner. Petitioner claims clean antecedent. Similarly situated co-accused persons have already been granted bail by this Hon'ble Court vide order dated 02.09.2025 in Cr. Misc. No. 57369 of 2025 .
5. Learned A.P.P. for the State vehemently opposed the bail application.

Considering the nature of accusation and clean antecedent, this anticipatory bail is allowed and it is ordered that let the above named petitioners in the event of their arrest/surrender before the court below within a period of eight weeks from today, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of Sub-Divisional Judicial Magistrate, Daudnagar, Aurangabad in connection with Bandeya P. S. Case No. 36 of 2025, subject to condition as laid down under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023.
