Petitioner seeks regular bail in connection with Special Case No.6467 of 2019, arising out of Punpun P.S. Case No.185 of 2019, for the offence punishable under Sections 147, 148, 149, 341, 323, 307, 337, 338, 427, 353, 379, 504 and 506 of the Indian Penal Code and Section 30(a) of the Bihar Prohibition and Excise Act, 2016.
The allegation against the petitioner is that a total quantity of 30 litres of illicit country-made liquor has been recovered from the hut of the petitioner.
Learned counsel appearing for the petitioner submits that the petitioner has got no criminal antecedent and has falsely been implicated in this case inasmuch the illicit liquor has not
Patna High Court CR. MISC. No.70695 of 2019(2) dt.04-12-2019 2/2 been recovered from the conscious possession of the petitioner and the petitioner is in custody since 21.07.2019. Having regard to the submissions made by the parties and taking into consideration the fact that petitioner is not named in the First Information Report and he is in custody since 21.07.2019, I am inclined to grant regular bail to the petitioner. Accordingly, let the petitioner, above named, be enlarged on bail on furnishing bail bond of Rs. 20,000/- (twenty thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge, Excise, Patna, in connection with Special Case No.6467 of 2019, arising out of Punpun P.S. Case No.185 of 2019.
