The petitioner seeks bail in connection with Sanhoula P.S. Case No. 164 of 2019 registered for the offences punishable under Sections 272, 273 of the Indian Penal Code and Section 30(a) of the Bihar Prohibition and Excise Act, 2016. Learned counsel for the petitioner submits that there is recovery of 829.08 liters of foreign liquor form the Pick-up Van. Learned counsel for the petitioner further submits that there is no recovery from the conscious possession of the petitioner. Petitioner is driver of the said Pick-up Van. Learned counsel for the petitioner further submits that the petitioner has got no criminal antecedent.

In the facts and circumstances of the case, I am

Patna High Court CR. MISC. No.73872 of 2019(2) dt.27-11-2019 2/2 inclined to grant bail to the petitioner, subject to deposit of Rs.15,000/- in the court below/Nazarat. Let the petitioner above named be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of 2nd Additional District and Sessions Judge-cum-Special Judge (Excise), Bhagalpur in connection with Sanhoula P.S. Case No. 164 of 2019.

Such deposit of Rs.15,000/- shall abide by the outcome of the criminal case.
