The instance application for regular bail has been filed by the petitioner in connection with Government Official Complaint P.S. Case No. 418 of 2022 instituted for the offence u/s 8(c), 20(b)(ii)(c) and 25 of the N.D.P.S. Act. Earlier, the application for regular bail of the petitioner was rejected by order dated 09.05.2023 passed in Cr. Misc. No. 1892 of 2023.

In pursuance to the direction of the Court, a Report with regard to present state of trial vide dt. 08.12.2023 has been received from which, it appears that the P.O. was on Earned Leave till 15.12.2023, later on she further extended

Patna High Court CR. MISC. No.80274 of 2023(3) dt.02-02-2024 2/2 her Earned Leave to perform ritual ceremony of her father. It also appears that once the P.O. joins, the case may be disposed of within three months.

No fresh ground is made for reconsideration of the regular bail application of the petitioner. Accordingly, this application is rejected. The bail application stands disposed of.

However, learned trial Court is directed to conclude the trial as per stipulated period of time i.e. three months on day to day basis, failing which the petitioner may renew his prayer for bail application.
