The petitioner in this case is seeking regular bail in connection with Kanti P.S. Case No. 363 of 2019 registered for the offences punishable under Sections 25(1-B)A, 26, 35 of the Arms Act.

Learned counsel for the petitioner submits that in fact nothing has been recovered from conscious possession of the petitioner but the Police has planted a country made pistol and 3 live cartridges and implicated the petitioner for possessing the same. He is in custody since 23.05.2019.

Learned APP has opposed the prayer of bail.

Considering the facts and circumstances of the case

Patna High Court CR. MISC. No.74068 of 2019(2) dt.11-12-2019 2/2 wherein this petitioner has been arrested with loaded pistol, has remained in custody for six months but has got three criminal antecedents on his head and it is not stated in the petition that whether he is on bail in those cases, this Court is not inclined to grant regular bail to the petitioner at this stage. The application is dismissed.

The petitioner may renew his prayer for bail after a reasonable time.
