2. The petitioner has prayed for regular bail in a case registered for the offence punishable under Sections 363, 365, 366, 120B, 34 of the Indian Penal Code.

3. The learned counsel for the petitioner has submitted that vide order dated 03.11.2023 passed in Cr. Misc. No. 55792 of 2023, the petitioner was given a liberty to renew his prayer for bail if the trial is not concluded within a period of nine months. From then, more than nine months have elapsed and from the perusal of the report of the POCSO Court, Supaul, it transpires that till today, none of the prosecution witness has been examined. It means that the trial has still not started. Petitioner is in custody since 25.08.2022.

6. Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with S.T. No. 249 of 2023 in POCSO Case No. 108/24 arising out of Chhatapur P.S. Case No. 281 of 2017 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional D.J.-VI-cumSpecial Judge-POCSO Court, Supaul.
