Petitioner seeks pre-arrest bail in Gogri P.S.Case No.187 of 2018 /G.R.No.1433/18 registered for the offences under Sections 304/34 of the Indian Penal Code.

Allegation, as per the F.I.R., against the petitioners is that operation was performed on the daughter of the informant and she died during the course of operation.

Submission of the learned counsel for the petitioner is that he is not doctor rather he is compounder. There is nothing against the petitioner. He has got no criminal antecedent. Heard learned A.P.P. also.

Having heard both sides and in view of the facts and circumstances of the case, as stated above, let the petitioner,

Patna High Court Cr.Misc. No.50613 of 2018 (2) dt.31-08-2018 2/2 named above, in the event of his arrest or surrender before the learned court below within six weeks from today be released on bail on furnishing bail bond of Rs.25,000/- with two sureties of the like amount each to the satisfaction of the C.J.M.,Khagaria, in Gogri P.S.Case No.187 of 2018 / G.R.No.1433/18 subject to the conditions as laid down under Section 438(2) of Cr.P.C. and

(1) one of the bailors must be a local person having sufficient immovable property within the jurisdiction of the concerned court. (ii) the petitioner will not induce any witness or tamper with the evidence and the petitioner shall co-operate in the investigation of the case and make himself available as and when required by the police, otherwise, the prosecution is free to move for cancellation of his bail bond.
