Petitioner apprehends his arrest in connection with Bhaptiyahi P.S. Case No.67 of 2018, for the offence punishable under Sections 302, 120(A), 34 of the Indian Penal Code. The accusation is that at about 9:45 P.M., on 18.06.18 Mahmood went to call, Md. Noor Alam, brother of informant Md. Miraj at the house of Md. Muslim then saw quarrel there and raised alarm then informant also reached there and saw that Md.Faruque caught hold his both Md. Noor Alam and Md. Juber was causing injury at his chest through onpti, Md. Muslim also caused injury. Md. Mahmood fired through pistol Md. Noor Alam died in way of hospital.

No.73128 of 2019(2) dt.21-11-2019 2/2 Learned counsel for the petitioner submits that the petitioner is named in the FIR but no specific allegation has been made against her, she being the wife of co-accused Zuber, she has falsely been implicated in this case. Having regard to the facts and circumstances of the case, let the above named petitioner, Fatima Khatoon @ Fatma Khatoon, be released on bail, in the event of pre-arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Supaul, in connection with Bhaptiyahi P.S. Case No.67 of 2018, subject to the condition as laid down under Section 438 (2) of Cr.P.C. (Rajendra Kumar Mishra, J) sanjeev/- U T
