The petitioner is apprehending his arrest in connection with Sakra P.S.case No.251 of 2017 registered for offences punishable under Sections 304B/34 of the Indian Penal Code. Allegation against the petitioner, who happens to be husband, is of dowry death.

Submission of the learned counsel for the petitioner is that she was under treatment and she died, information was given to the father of the deceased and later on a case was lodged due to some ulterior motive.

Heard learned A.P.P. , who has opposed the prayer for bail stating that there is allegation of demand and torture against the petitioner and he is husband. .

Patna High Court Cr.Misc. No.51078 of 2018 (2) dt.05-09-2018 2/2 Having heard both sides and in view of the facts and circumstances, as stated above, I am not inclined to grant anticipatory bail to the petitioner.

With the aforesaid observation, this application is dismissed.
