JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 02/ 20.09.2018 Heard learned counsel for the petitioner as well as learned Addl. Public Prosecutor for the State. Petitioner apprehends his arrest in connection with Lakhisarai P. S. case no. 245/2018 registered under sections 272, 273 of the IPC and sections 30(a), 38(1), 41(1) of the Bihar Prohibition and Excise Act.
In huge quantity Indian made foreign liquors were recovered from a pick up van. The petitioner happens to be owner of aforesaid pick up van.
Therefore, considering the aforesaid facts and circumstances, I do not feel it proper to extend the privilege of anticipatory bail to the petitioner and accordingly, his prayer for anticipatory bail stands rejected. However it is made clear that if the petitioner surrenders and seeks regular
Patna High Court Cr.Misc. No.57284 of 2018 (2) dt.20-09-2018 bail before the learned trial court within six weeks from today, the learned trial court shall consider the regular bail application of the petitioner on its own merit without being prejudiced by this rejection order.
