JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 06-02-2020 Heard learned counsel for the petitioner and State. The petitioner is in custody in connection with Sarmera P.S. Case No. 78 of 2017 for the offence under Sections 341, 323, 326, 307 and 504/34 of the Indian Penal Code and Section 27 of the Arms Act.

Learned counsel for the petitioner submits that the petitioner has got no criminal antecedent and he is in custody since 09.07.2019. He submits that on account of the land dispute, incident took place. It is alleged that the petitioner along others started throwing brick-bats on the informant which hit Mahesh Yadav..

Considering the fact that the petitioner has got no criminal antecedent and the injury sustained by Mahesh Yadav is not on vital part of his body, the Court is inclined to grant bail

Patna High Court CR. MISC. No.70492 of 2019(3) dt.06-02-2020 2/2 to him. The petitioner, named above, is directed to be released on bail on furnishing bail bonds of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the concerned Judicial Magistrate 1st Class, Nalanda at Biharsharif in connection with Sarmera P.S. Case No. 78 of 2017.
