JUSTICE SANDEEP KUMAR ORAL ORDER 08-12-2023 This is the third attempt of the petitioner for grant of regular bail as earlier the bail applications of the petitioner was rejected vide orders dated 24.05.2022 and 22.02.2023 passed in Cr. Misc. No. 5652 of 2022 and Cr. Misc. No. 11650 of 2023 respectively.

2. Heard learned counsel appearing on behalf of the petitioner and learned APP appearing on behalf of the State.

3. The petitioner seeks bail in connection with Rail Chhapra (Kachahri) P.S. Case No. 156 of 2021 registered for the offence under Sections 401/414 of the Indian Penal Code and under Section 20/22 of the NDPS Act.

4. As per the prosecution case, the petitioner is accused of looting people after giving them poisonous substance.

5. As per the submission of the learned counsel for the petitioner, charges have been framed against the petitioner and learned counsel for the petitioner further submits that some of the other co-accused have been granted bail by this Court.

6. In view of the serious allegations, as mentioned above, this Court is not inclined to grant bail to the petitioner.

7. Accordingly, the prayer of bail of the petitioner is rejected herewith.
