1. Heard learned counsel for the petitioner and learned A.P.P. for the State.

2. The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 191(2), 190(2), 115, 109, 351(2), 352 and 3(5) of the BNS.

Learned counsel for the petitioner submits that petitioner is a person with clean antecedent and the informant alleges that on 31.07.2025 his brother saw the named accused persons including the petitioner cutting the ridge of his field and on protest all the five named accused started assaulting him. On alarm, informant along with Satyendra reached the place of occurrence when petitioner brought farsa from his house and assaulted him and his brother by lathi and farsa causing injury on head of all the three while Saroj threatened with gun.

4. Learned counsel for the petitioner submits that petitioner has been falsely implicated in the instant case by the

Patna High Court CR. MISC. No.76665 of 2025(3) dt.17-12-2025 2/2 informant. It is further submitted that from the side of the petitioner also Piro P.S. Case No. 237 of 2025 has been instituted against the informant and his side. It is next submitted that on account of dispute relating to cutting of ridge an altercation took place in which both sides assaulted each other. It is also submitted that the date of occurrence is 31.07.2025 and the FIR came to be instituted on 02.08.2025 i.e. after a delay of two days without any plausible explanation. It is reiterated and submitted that petitioner is not a criminal and will not abscond and will cooperate in the investigation to prove his innocence.

5. Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioner.

Considering the submissions made by the learned counsel for the petitioner, let the petitioner above-named, in the event of his arrest or surrender before the learned trial court within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned trial court where the case is pending/Successor Court in connection with Piro P.S. Case No. 234 of 2025, subject to the conditions as laid down under Section 482(2) of the BNSS.
