The petitioner has filed the instant application for grant of regular bail in a case registered for the offences punishable under Sections 120(B), 307 of the Indian Penal Code and Section 25(1-B)A, 26, 35, 27 of Arms Act.

Allegation against the petitioner and other coaccused persons is that they opened fire but no one hit. It is further alleged that one country made pistol has been recovered from a car bearing Reg. No. BR-44Q9688.

No.81924 of 2023(2) dt.02-01-2024 2/3 It is submitted by learned counsel for the petitioner that the petitioner is innocent and he has falsely been implicated in the present case. Neither the petitioner was apprehended on spot nor anything incriminating has been recovered from his conscious possession. The said car from which country made pistol was recovered, does not belong to petitioner. There is case and counter case between the parties. Moreover, the petitioner is languishing in judicial custody since 25.09.2023.

Learned APP appearing for the State has vehemently opposed the prayer for Bail.

Having heard learned counsel for the parties and taking into consideration the facts and circumstances of the case as well as period of custody, this Court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail in connection with Rajpur P.S. Case No. 128 of 2023 on furnishing bail bond of Rs. 10,000/- (Rupees
