The petitioners are apprehending their arrest in a case registered under Sections 341, 323, 324, 307, 379, 506/34 of the Indian Penal Code.

The prosecution case, in brief, is that on call, the informant reached Hathiya Bahiyar temple, where he was assaulted by the accused persons.

It has been submitted on behalf of the petitioners that the petitioners have got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioners. The petitioners have been made accused due to previous enmity.

Patna High Court Cr.Misc. No.52658 of 2018 (2) dt.11-09-2018 Nature of injury is said to be simple in nature. No offence u/S 307 of the Indian Penal Code is made out.

Learned counsel for the State submits that the petitioners are named in the Complaint/FIR.

Considering the aforesaid facts and circumstances, let the petitioners, above named, in the event of arrest/surrender before the learned court below within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-III, Banka in connection with Bandhuwa Kurawa P.S. Case No. 60 of 2017, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
