The petitioner seeks bail in a case registered under Section 392 of the Indian Penal Code.

Three motorcycle borne criminals are said to have looted cash of Rs.90000/-, tablet, mobile and purse of the informant.

It is submitted by learned counsel for the petitioner that the petitioner has no concern with the aforesaid occurrence. He is not named in the F.I.R. There is nothing cogent on record indicating the complicity of the petitioner in the occurrence barring the confessional statement of co-accused Md. Rabul and Amer Kumar Paswan which has no evidentiary

Patna High Court CR. MISC. No.72241 of 2019(2) dt.04-12-2019 2/2 value in the eye of law. No incriminating article has been recovered from the conscious physical possession of the petitioner. He was not put on T.I.P. Said Md. Rabul, Amer Paswan and one another accused have been enlarged on regular bail by learned lower court. He has been languishing in custody since 30.07.2019.

Having regard to the facts and circumstances of the case, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Araria in connection with Raniganj P.S. Case No. 469 of 2018.
