JUSTICE VINOD KUMAR SINHA ORAL ORDER 15-11-2019 This application, for grant of anticipatory bail, arises out of Rajepur P.S. Case No. 31 of 2019, disclosing offences under Sections 25(1-b)a, 26 and 35 of the Arms Act. Allegation as per F.I.R. is that three persons riding on the motorcycle were intercepted by the police and one of them managed to flee away and it is said that from one of the accused persons one loaded country made pistol has been recovered and they disclosed the name of petitioner as their associate. Submission of learned counsel for the petitioner is that he has no criminal antecedent and has falsely been made accused in this case only on the basis of disclosure made by coaccused persons and except that there is nothing against the petitioners and he is ready to abide by any condition imposed on him.

Having heard both sides, considering the submission, as above, this application is allowed. Let the petitioner, above named, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty five Thousand) each with two sureties of the like amount each to the satisfaction of learned SDJM, Sadar Motihari, East Champaran, in connection with Rajepur P.S. Case No. 31 of 2019, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure with further subject to the condition that petitioner will cooperate in investigation and appear before the police as and when required.
