JUSTICE VINOD KUMAR SINHA ORAL ORDER 13-01-2020 Petitioner seeks regular bail in connection with Kadwa P. S. Case No. 40 of 2019 registered for the offence punishable under Section 25(1-b)a/26 of the Arms Act. As per F.I.R. petitioner was named as an accused in earlier case, the police on information that he is in his house, raided his house and arrested him and there is recovery of one stolen motorcycle and one firm arm with cartridge. It further appears that he is accused in five other cases. Submission of the learned counsel for the petitioner is that he has already remained in custody for about eleven months and he is ready to abide by any condition imposed on him. Heard learned A.P.P. also.

Having heard both sides, in view of the facts and circumstances, as stated above, let the petitioner above named,

Patna High Court CR. MISC. No.74358 of 2019(2) dt.13-01-2020 2/2 be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount to the satisfaction of learnedC.J.M. Katihar, in connection with Kadwa P. S. Case No. 40 of 2019, subject to the condition that one of the bailors of the petitioner shall be a local person having sufficient immovable property within the jurisdiction of the court concerned with condition that after release, he has to appear before the police of his local area in the first week of each month for a period of nine months or till the conclusion of the trial, whichever is earlier, so that the police may watch his conduct, otherwise his bail bond shall be cancelled.

Let a copy of this order be communicated to the S.P. Katihar, for needful.
