2. Petitioner seeks regular bail in case registered for the offences punishable under Sections 103 (1) and 238 of BNS and 27 of Arms Act.
3 . The prosecution case , in brief, is that informant namely , Salma devi alleged that on 28.02.2025 , her sons, Asraf and Faruque, had gone to attend a marriage ceremony. Subsequently, informant received information that her sons had

4. Learned counsel for the petitioner submitted that petitioner is not named in the F.I.R. The name of the petitioner transpired on the confessional statement of other co-accused persons. During course of investigation , it has come that one Muskan Kumari with whom it is sated that one of the deceased was having love affair has also not named this petitioner. The only material that has come against this petitioner is that his tower location was found near the place of occurrence . Petitioner also resides in the same locality . Except this, there is no other material is available on record to suggest his involvement in the alleged occurrence . Petitioner is in custody since 24.09.2025 . Similarly situated co-accused persons has already been granted bail by co-ordinate Bench of this Hon'ble Court vide order dated 06.08.2025 in Cr. Misc. No. 36481 of 2025 .
5. Learned A.P.P. for the State vehemently opposes the bail application.
6. Considering the aforesaid facts, materials available on record, period of custody and other circumstances of the case , the bail application is allowed. Let the above named petitioner
