JUSTICE RAJIV ROY ORAL ORDER 24-07-2023 No one appears on behalf of the petitioner, although learned counsel appearing on behalf of the respondent no. 7, the Managing Director, Central Co-operative Bank Limited, Begusarai is present.

It has been informed by the learned counsel for the Bank that the petitioner has rushed to the Court merely on the direction to make payment failing which he will be declared defaulter and the Authority will be free to act in accordance with law.

The last submission is that in similar situate matter in CWJC No. 23354 of 2019, a co-ordinate bench of this court on 25.11.2019 had given liberty to the petitioner to explain the circumstances by submitting reply, who shall take decision in accordance with law.

This Court takes the same route giving liberty to the petitioner to file a comprehensive reply before the concerned District Co-operative Officer, Begusarai who shall act in accordance with law and communicate the said decision to the petitioner.

The writ petition stands disposed off with the aforesaid observation.
