JUSTICE ASHWANI KUMAR SINGH ORAL ORDER 10-12-2018 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State. The petitioner seeks pre-arrest bail in connection with Udakishunganj Madhepura P. S. Case No.61 of 2018 registered under Sections 4 and 33 of Bihar Minor Mineral Concession Rules, 1972, Section 15 of the Environment Protection Act, 1986 and Section 3 and 4 of Bihar Minerals (Prevention of Illegal Mining, Transportation and Storage) Rule, 2003.

It is submitted by the learned counsel for the petitioner that the petitioner has deposited all amount with interest through bank draft of Rs.1,58,000/- in the Mining Office on 12.07.2018. It is further contended that co-accused Pinaki

Patna High Court Cr.Misc. No.59941 of 2018(2) dt.10-12-2018 2/2 Ranjan Rai having more or less identical allegation has already been granted pre-arrest bail vide order dated 18.05.2018 passed in Cr. Misc. No. 26901 of 2018 by a co-ordinate Bench of this Court.

Considering the submission made above, in the event of arrest or surrender before the court below within six weeks from today, the petitioner named above is directed to be released on bail on furnishing bail bond of Rs.10,000/- ( Rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned SDJM, Udakishunganj (Madhepura) in Udakishunganj Madhepura P. S. Case No.61 of 2018, G.R. No. 261 of 2018, subject to the conditions as laid down under Section 438 (2) of the Code of Criminal Procedure. (Ashwani Kumar Singh, J) kanchan/- U T
