The petitioner filed this Criminal Miscellaneous for modification of the order dated 28.06.2016 passed in Cr. Misc. No.13703 of 2016 and for extension of time to surrender in court. Learned counsel for the petitioner submits that 29 persons including the petitioner was granted anticipatory bail vide order dated 28.06.2016 passed in Cr. Misc. No.13703 of 2016 but the petitioner could not surrender in court within four weeks from the date of the order. The petitioner was under treatment outside the State and he had no knowledge that he was granted anticipatory bail.
It appears that although the petitioner was granted anticipatory bail he knowingly did not surrender in the court for more than two years nor filed any petition for extension of time
Patna High Court Cr.Misc. No.24429 of 2018 (2) dt.29-08-2018 2/2 for the reasons best known to him. The petitioner avoids the order of the court for more than two years and only thereafter filed petition for modification.
Thus, I do not find any merit in the petitioner to modify the order dated 28.06.2016 passed in Cr. Misc. No.13703 of 2016 and accordingly the same is dismissed.
