2. This is the second attempt on behalf of the petitioner for grant of bail in connection with Bachhwara P.S. Case No. 256 of 2023 registered for the offence punishable under Sections 366A, 511, 341, 323, 504 and 506 of the Indian Penal Code.

3. Earlier the bail application of the petitioner has been rejected vide order dated 18.01.2024 passed in Cr. Misc. No. 1397 of 2024.

4. The following order was passed on 18.01.2024 in Cr. Misc. No. 1397 of 2024 which reads as under: "Heard the learned counsel for the petitioner and learned APP for the State.

2. The petitioner seeks regular bail in a case registered for the offence under Sections 366A, 511, 341, 323, 504 and 506 of the Indian

Patna High Court CR. MISC. No.83987 of 2024(3) dt.19-03-2025 2/2 Penal Code.

3. The petitioner is accused of taking away the victim girl.

4. The statement of the victim girl made under Section 164 of the Cr.P.C. supports the allegations levelled against the petitioner. The Petitioner is in jail since 30.09.2023. The petitioner has two criminal antecedent.

5. Considering the aforesaid facts and circumstances of the case, I am not inclined to grant bail to the petitioner. This application for regular bail is dismissed for the present.

6. The petitioner may renew his prayer for bail if there is no sufficient progress in the trial."

5. From the report of the trial Judge, it appears that two witnesses have already been examined.

6. Considering the fact that the trial has started and witnesses have been examined, I am not inclined to grant bail to the petitioner.

7. Accordingly, the application stands dismissed.

8. The Superintendent of Police, Begusarai is directed to ensure the appearance of the witnesses in the trial.

9. Let a copy of this order be communicated to the Superintendent of Police, Begusarai for its compliance through FAX or e-mail forthwith.
