JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 20-09-2018 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner apprehends his arrest in connection with Madhuban P.S. Case No. 127 of 2018 registered for the offence punishable under Section 7 of E. C. Act.

The petitioner happens to be P.D.S dealer and the Block Supply Officer, Tetariya claims in his written report that he seized a pick up van laden with bags of wheat and in course of inquiry, he came to know that the seized bags belongs to the petitioner.

There is nothing in the first information report that

Considering the aforesaid facts and circumstances as well as submissions of the parties, this anticipatory bail petition is allowed and it is ordered that petitioner, above named, in the event of his arrest/ surrender within four weeks from the date of receipt of this order to the court concerned, shall be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Motihari, East Champaran in Madhuban P.S. Case No. 127 of 2018, subject to conditions as laid down under Section 438(2) of the Cr.P.C.
