====================================================== CORAM: HONOURABLE JUSTICE SMT. SONI SHRIVASTAVA ORAL ORDER 29-04-2025 On repeated calls, no one appeared on behalf of O.P. No.2. However, the learned counsel for the petitioner is present.
2. The petitioner apprehends his arrest in a case registered for the offences punishable under Section 498A of the Indian Penal Code.
3. Petitioner, who is husband of opposite party no2., is said to have ousted the opposite party no.2 from her matrimonial home in association of his family members over the dowry demand.
4. It is submitted that the allegation leveled in the complaint case are not correct and as a matter of fact, the
Patna High Court CR. MISC. No.82774 of 2024(3) dt.29-04-2025 2/2 petitioner never indulged in any demand of dowry or treating his wife with cruelty, rather the petitioner has made a specific submission in paragraph 15 of his petition that he is ready to keep his wife with full dignity and honor.

In such view of the matter, let the above named petitioner, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate First Class, Jhanjharpur, Madhubani, in connection with C.R. Case No.381 of 2021, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure/Section 482
(2) of the B.N.S.S., 2023 and subject to the further condition that the petitioner shall co-operate in the investigation/trial. In any case of violation of the same, the opposite party No. 2 is at liberty to approach the learned Court below for cancellation of anticipatory bail of the petitioner.
