The petitioner is in custody since 13.09.2019 in connection with Special (Excise) Case No. 443 of 2019 arising out of Saharsa Sadar P.S. Case No. 833 of 2019 for the offence registered under Sections 30 (a), 38(1), 41 (1) of the Bihar Prohibition and Excise Act, 2016.

Learned counsel for the petitioner submits that the petitioner is the driver of the vehicle in which alleged recovery was made. It is further submitted that the petitioner, being merely the driver, was not aware of this fact and nothing is recovered from his possession.

Considering the aforesaid facts and circumstances of the case and that the petitioner has no criminal antecedent, let

Case No. 833 of 2019.
