The petitioner seeks regular bail in connection with Simri P.S. Case No. 164 of 2019/Darbhanga G.O. Case No. 933 of 2019 for the offence registered under Sections 272, 273, 420 and 307 of the Indian Penal Code and Sections 30(a) (c) (d), 38(1), 41 and 36 of the Bihar Prohibition and Excise Act, 2016. The allegation is regarding recovery of two litres of Deshi Chulai liquor and 500 grams of DAP fertilizer from the house of the petitioner.

The learned counsel for the petitioner has submitted that the petitioner is innocent and has been falsely implicated in the present case. It is further submitted that the petitioner is

Having regard to the facts and circumstances of the case and considering the submissions advanced by the learned counsel for the petitioner, I deem it fit and proper to direct the petitioner herein to be released on bail.

Accordingly, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned A.D.J.-2nd-cum-Special Judge (Excise), Darbhanga in connection with Simri P.S. Case No. 164 of 2019/ Darbhanga G.O. Case No. 933 of 2019.
