The petitioners are apprehending their arrest in a case registered under Sections 341, 323, 307, 379, 504, 506, 34 of the Indian Penal Code.
The prosecution case, in brief, is that on the issue of price of brick, an altercation took place. It is alleged that the accused persons having abused the informant, assaulted him with butt of the rifle.
It has been submitted on behalf of the petitioners that the petitioners have got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioners. The petitioners have been falsely implicated in the present case. The
Patna High Court Cr.Misc. No.59976 of 2018 (2) dt.10-10-2018 matter has already been compromised between the parties which would be evident from Annexure-3 to this application. On behalf of the State, it is submitted that the petitioners are named in the Complaint Case/F.I.R.
Considering the aforesaid facts and circumstances, let the petitioners, above named, in the event of arrest/surrender before the learned court below within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-IV, Saran at Chapra in connection with Panapur P.S. Case No. 23 of 2018, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
